Ernie’s Gutter · Clear Terms and Expectations

Terms of Use

Understand how to use our website, what an online inquiry means and which documents govern your actual project. Your estimate, service agreement and applicable legal rights remain important.

Original effective date: October 27, 2025 Last revised: October 30, 2026

Information Before Action

Website guides explain options. Your property’s conditions and an appropriate assessment determine the work needed.

Your Project Has Its Own Terms

An inquiry is not a work order. Your accepted estimate, service agreement and applicable law govern the job.

Privacy Stays Clear

Information practices are explained in one place: our separate Privacy Policy.

1. Who These Terms Cover

These terms describe permitted use of erniesgutter.com, the website of Ernie’s Gutter ("we," "our" or "us"). They concern browsing, website content and online inquiries. They are not the complete agreement for construction, repairs, materials or other paid services.

The business named in your accepted estimate or service agreement is the contracting party for that work. A link to Ernie’s Roofing or another business does not make these website terms that business’s service contract.

Please review these terms before using the site. If you disagree with the permitted-use conditions, discontinue use. Where an enforceable agreement requires notice, consent or a particular acceptance process, those requirements still apply.

2. Website Information and Safe Decisions

Articles, guides, diagrams and general recommendations provide background information. They do not replace an on-site inspection, project-specific measurements, engineering when needed, manufacturer instructions or applicable building requirements.

Conditions such as concealed wood damage, roof runoff, drainage restrictions and existing connections can change the appropriate solution. General sizing examples, cost discussions and maintenance suggestions may not fit your property.

Do not climb onto roofs, use unsafe ladders, approach power lines, enter unstable areas or excavate around utilities based solely on website instructions. Use qualified help when the work requires it. For immediate danger, contact the appropriate emergency service or utility; an online inquiry is not an emergency response system.

3. Estimates, Scheduling and Service Agreements

Submitting a form, sending photographs or clicking a telephone button requests communication. It does not, by itself, authorize work, reserve a crew, establish a final price or create a payment obligation.

Website or inquiry item What determines your project
General prices, examples and descriptions The scope, conditions and pricing stated in the estimate or agreement accepted for your job.
Requested appointment or start date Direct scheduling confirmation, subject to the applicable agreement and actual conditions.
Deposits, payment, cancellation and changes Your accepted agreement and applicable law. This page creates no new fees or cancellation penalties.
Materials, colors, profiles and quantities Confirmed selections, measurements and the agreed scope, including any properly approved changes.

Weather, material availability, site access and concealed conditions may affect a project. Any resulting change to scope, price or timing must be handled under the applicable agreement and law; this page is not automatic permission to change your job.

Your project agreement matters. Keep your estimate, accepted scope, change approvals, invoices and warranty documents. These website terms do not replace or silently amend them, and do not remove rights that applicable law protects.

4. Warranties, Claims and Project Images

Workmanship and manufacturer warranties are distinct. Coverage, duration, exclusions and claim procedures depend on the warranty actually provided for your project and applicable law. Contact us for the relevant documents before approving work.

This page does not create a new lifetime warranty, a guarantee of insurance coverage or a promise that every product will prevent every leak, clog or drainage problem. It also does not cancel a warranty, advertised commitment or legal protection that otherwise applies.

Project photographs show particular conditions and work. Diagrams, illustrations and sample images explain concepts or design choices. An image alone does not establish your property’s condition, the scope included in your estimate or the result a different property will achieve. Screen colors can differ from actual materials; confirm selections using available product samples.

5. Inquiries and Electronic Communications

Provide accurate contact and project information. Requests and work approvals should come from an adult with authority to act for the property owner or business. Tell us if you are a tenant, property manager or other representative so the necessary authorization can be arranged.

We may reply by telephone or email about your request. Sending an inquiry does not authorize unrelated marketing, public use of your project photos or a text-messaging program. We do not record customer calls or operate a customer SMS program.

A website confirmation means a submission was received by the website system; it does not necessarily confirm that staff have reviewed it or accepted a job. If your message is time-sensitive or you do not receive a response, call 720 346 ROOF.

Electronic approvals and signatures may be used when the parties agree to that process. These website terms do not make every message, button click or form submission a signature on a construction contract.

6. Acceptable Website Use

You may browse the site, use its ordinary features and contact us about legitimate business matters. Do not:

  • Send spam, malicious files, fraudulent inquiries or another person’s private information without authority.
  • Attempt unauthorized access, bypass security controls or interfere with the website or its users.
  • Use automated requests that overload the site or evade reasonable access restrictions.
  • Impersonate Ernie’s Gutter, misrepresent your relationship with us or use our branding to mislead others.
  • Copy or exploit protected material beyond permission granted here or rights provided by law.

We may limit website access or remove content we control to address abuse, security problems or legal requirements. Such action does not cancel an existing service agreement or eliminate applicable customer rights.

7. Content Ownership and Permitted Sharing

Website text, photographs, graphics, branding and other material are owned by Ernie’s Gutter or used with rights from their respective owners. Third-party names, trademarks, reviews and materials remain subject to their owners’ rights.

You may view, print or save reasonable portions for personal use or to evaluate a project, keeping ownership notices intact. Commercial republication, resale, misleading reuse of project images or use of our logo to imply endorsement requires the appropriate permission, except where the law permits otherwise.

You may share ordinary links to public pages without implying sponsorship or endorsement. For media, vendor or other reuse requests, email ernie@erniesgutter.com. If you believe material on this site infringes your rights, identify the material and explain your concern so we can review it.

8. Photographs, Documents and Honest Reviews

Send only photographs, plans, documents and messages that you have authority to share. Remove unrelated private information, access codes, account credentials and sensitive details before submitting them.

When you provide project materials, you authorize us to use and share them as reasonably needed to evaluate your request, prepare an estimate, coordinate approved work and maintain related business records, as described in our Privacy Policy. You retain your ownership rights.

Completed-project advertising: we may ask the property owner or an authorized representative for separate written permission to photograph and advertise completed work. That permission will identify the approved material and uses, such as our website, Google Business Profile, social media, digital advertisements or printed materials.

Submitting project information, using this website or hiring us does not automatically grant that promotional permission. Permission for project photographs does not include a customer’s name, face, testimonial, street address, visible house number or other identifying details unless separately authorized. The permission must also respect the rights of the photographer and anyone else whose approval is required.

Nothing in these terms prohibits honest reviews, imposes a penalty for a negative review or requires you to transfer ownership of a review. Content on a third-party review platform is also subject to that platform’s terms.

9. Privacy and Third-Party Services

Our separate Privacy Policy explains customer information, cookies, Google measurement and advertising tools, reCAPTCHA, review features and privacy requests. This page does not create a second, different privacy policy or replace any consent or opt-out required by law.

External links, embedded features and third-party services are controlled by their providers. Review their notices and terms before using them. A link alone does not mean we endorse all of a provider’s statements or guarantee its availability, security or performance.

Do not send full payment-card details, bank credentials, Social Security numbers or passwords through ordinary contact forms or email.

10. Website Availability and Limits

We aim to keep the website useful and accurate, but pages can contain errors, become outdated or be unavailable. Contact us to confirm information important to a purchase or project. We may correct errors, maintain the site or change website features.

To the extent permitted by applicable law, the website and its general informational content are provided "as is" and "as available," without a separate promise of uninterrupted access, error-free operation or suitability for every property.

To the extent permitted by applicable law, Ernie’s Gutter is not responsible for indirect or consequential losses arising solely from use of, or inability to use, this website. This limitation concerns the website; it does not replace the terms governing paid work.

Nothing here excludes responsibility that cannot lawfully be excluded, excuses fraud or willful misconduct, disclaims liability for gross negligence, overrides an applicable warranty or limits a consumer right or remedy that the law protects.

11. Colorado Law and Resolving Concerns

Colorado law governs these website terms, subject to applicable federal law and mandatory protections that cannot be displaced by a choice-of-law provision.

If you have a website or service concern, contact us with the relevant page, project details and the outcome you are requesting. This invitation to communicate does not prevent you from contacting a regulator, using a lawful dispute process or exercising a legal right.

This page does not impose mandatory arbitration, a class-action waiver, a shortened deadline for bringing a claim or a new dispute fee. A separate project agreement may address disputes, subject to applicable law.

If a provision cannot lawfully be enforced, it applies only to the extent permitted, and the remaining provisions continue to the extent they can operate lawfully.

12. Changes to These Website Terms

We may update these terms to reflect website changes, business practices or legal requirements. The revision date appears at the top. Updated terms are intended for future website use; they do not retroactively change an accepted project agreement or remove accrued rights.

If a change requires additional notice or acceptance to become effective, that process must occur. Posting revised terms does not, by itself, supply consent required for a new use of personal information.
